FAQ
Frequently Asked Questions About GPSR Solutions' Compliance Services
1. Understanding GPSR Compliance
What is GPSR, and who does it apply to? The General Product Safety Regulation (GPSR) applies to all consumer products sold in the European Union. It ensures that products meet safety standards, requiring businesses to carry out risk assessments, maintain technical documentation, and designate an EU Authorised Representative for non-EU companies. GPSR Solutions helps you comply with all these requirements through one complete package.
What happens if I don’t comply with GPSR? Non-compliance can lead to serious consequences, including product recalls, bans, removal from online marketplaces, fines, or legal actions. EU market surveillance authorities can request documentation at any time, and failure to provide it may result in enforcement actions.
Does GPSR apply to all product categories? Yes, GPSR covers all consumer products unless specific EU regulations (e.g., for medical devices or food contact materials) take precedence. If your product is covered by multiple regulations, it must comply with all of them.
2. GPSR Solutions' Compliance Services
How does GPSR Solutions help with compliance? We provide an end-to-end GPSR compliance package, including:
- Risk Assessment: Structured analysis of product safety hazards, based on materials, age grading, and use cases.
- GPSR Certification: Official compliance documentation confirming your product meets EU GPSR requirements.
- Labeling Review: We verify safety warnings, usage instructions, and compliance markings against EU standards.
- Technical Documentation: Complete compliance files, including conformity declarations, risk findings, and traceability records.
- EU Authorised Representative: Legally required for non-EU companies. We serve as your EU contact point and maintain your compliance files.
- Marketplace Registration: We register you with the EU Safety Gate Portal, required for sellers on Amazon, Shopify, and other ecommerce platforms.
Why do I need an EU Authorised Representative? If you are based outside the EU, you are legally required to appoint an EU Authorised Representative. This representative must hold your documentation, respond to regulatory authorities, and ensure your product remains compliant.
Can GPSR Solutions act as my Authorised Representative? Yes. GPSR Solutions is headquartered in the U.S., but our EU office is based in Germany. We act as your official EU Authorised Representative with no annual renewal fees.
Can I switch to a different Authorised Representative later? Yes. You can change representatives at any time. You’ll need to update your product labels and documentation, and potentially re-register with the EU Safety Gate Portal. We do not charge any cancellation or transfer fees.
3. Technical Documentation & Risk Assessment
Do I need a risk assessment for each product? Yes. GPSR requires a unique, documented risk assessment for each product type to evaluate potential hazards and mitigation steps. This is a core part of compliance.
What’s included in a GPSR-compliant risk assessment?
- Product description, use case, and age grading
- Economic operator info (manufacturer, importer, authorised rep)
- Materials and components
- Legal standards (GPSR, REACH, EN standards, etc.)
- Design hazards (chemical, electrical, flammability, mechanical)
- Risk ratings (critical, major, minor)
- Safety labeling and disposal guidance
What is technical documentation, and why is it required? This includes everything a market surveillance authority may request to confirm product safety:
- Risk assessments
- Test reports or certifications
- Supplier/manufacturer details
- Traceability documentation
- Declarations of conformity
- Labeling compliance
4. GPSR & Online Marketplaces
What does GPSR mean for online sellers (Amazon, Temu, Shein, etc.)? To sell on EU-facing platforms, you must:
- Appoint an EU Authorised Representative
- Register on the Safety Gate Portal
- Maintain product safety documentation
- Ensure correct labeling Failure to do so can lead to product delisting or account suspension.
Can GPSR Solutions help with Amazon’s requirements? Yes. We assist with all necessary documentation, labeling review, and your Safety Gate registration.
5. Certification & Pricing
Are your services one-time or subscription-based? All of our services are one-time fees. Once certified, we continue to serve as your EU Authorised Representative for the life of your product at no additional cost.
