GPSR Solutions – Subscription Policy

Effective Date: November 1st, 2025

1. Scope of Service

GPSR Solutions is a subscription-based compliance support service operated by EaseCert GmbH, Klaus-Kordel-Straße 4, 54296 Trier, Germany. It is designed for business customers marketing non-food consumer products in the European Union under Regulation (EU) 2023/988 – the General Product Safety Regulation (GPSR).

The subscription may include:

  • General Product Safety risk assessments
  • Technical documentation creation and maintenance
  • EU Declaration of Conformity drafting
  • Multilingual labeling guidance
  • Ongoing compliance monitoring and updates
  • EU Responsible Person (RP) representation (only if expressly included in the service)

Each subscription tier covers a defined number of product types. A “product type” is determined based on material composition, construction, and intended use. Grouping unrelated items under a single type is not permitted.

2. Subscription Structure and Billing

GPSR Solutions is offered as a recurring service on a monthly or yearly billing cycle. By subscribing, you agree to automatic renewal at the end of each term unless cancelled in advance.

Key Terms:

  • All fees are listed in EUR unless otherwise displayed at checkout. VAT may apply where required.
  • Payment is due in advance at the start of each billing cycle.
  • You authorize EaseCert GmbH to process recurring payments using your selected method.
  • You are responsible for ensuring your payment method remains valid during your subscription.

Pricing reflects the continuous nature of the compliance service, including technical file maintenance, document storage, and ongoing monitoring of legal updates.

3. Misuse and Short-Term Subscription Abuse

EaseCert actively monitors subscription activity and reserves the right to suspend or terminate subscriptions used in a manner inconsistent with continuous compliance service.

Important:

You may not subscribe for a single month solely to download documents or use the Germany-based EU Responsible Person address, then cancel. The RP address is legally valid only while your subscription is active and paid.

Once the subscription ends, authorization to use the RP address automatically expires. The address must be removed from all product labeling, packaging, and listings immediately.

Misuse consequences include:

  • Issuance of a formal cease-and-desist letter
  • Notification to EU market surveillance authorities
  • Liability for damages and legal costs

GPSR Solutions is not a one-time certification but a continuous compliance service.

4. Cancellation and Refunds

You may cancel your subscription at any time via your customer account or by emailing info@easecert.com.

  • Monthly subscriptions: Cancel anytime; service continues until the end of the current billing period. No refunds for partial months.
  • Yearly subscriptions: If cancelled within 14 days of payment and before any documentation work has begun, a full refund will be issued. Once work has started, the fee is non-refundable.

5. Subscription Scope and Product Limits

Each plan includes ongoing support for a defined number of product types, covering labeling compliance, technical documentation, and updates due to formulation or supplier changes.

If you exceed your plan’s scope, you must:

  • Purchase additional product coverage, or
  • Upgrade to a higher-tier plan

EaseCert reserves the right to pause documentation work if the active subscription no longer reflects your actual product portfolio.

6. Termination by EaseCert

EaseCert may terminate your subscription immediately if you:

  • Provide false or incomplete product information
  • Use the company name, address, or RP details without valid authorization
  • Reverse or dispute payments without notice
  • Knowingly violate EU product safety regulations

In such cases, no refund will be provided and access to all documentation will be revoked. Continued misuse of the RP address may lead to penalties up to EUR 5,000 per breach.

7. Service Delivery Timeframes

Delivery of compliance documentation depends on timely submission of required inputs (e.g. supplier documentation, bills of materials, SDS, or labeling).

Typical timelines:

  • Initial technical file: 5–10 business days from receipt of complete data
  • Updates or modifications: 3–5 business days
  • EU Declaration of Conformity: issued once risk analysis and labeling are finalized

Delivery times are estimates and may vary with documentation completeness, regulatory complexity, or workload.

8. EU Responsible Person Representation

If your subscription includes EaseCert | GPSR Compliance as your EU Authorized Representative / Responsible Person:

  • You will receive a formal statement confirming the appointment
  • You may use EaseCert’s German address only while your subscription is active
  • You must immediately cease use of the address upon cancellation or termination

EaseCert may notify EU authorities if your products continue to display the address without authorization.

9. Legal Limitations

EaseCert GmbH provides compliance support and representation services but is not a notified body or certification authority. It is not responsible for:

  • Product defects, recalls, or enforcement actions caused by incomplete or inaccurate product data provided by the customer
  • Compliance under legislation outside the GPSR scope unless covered by separate agreement

EaseCert’s total liability for any claim is limited to the subscription fees paid during the 12 months preceding the claim. The Customer remains legally responsible for product compliance as the manufacturer or importer.
